TERMS AND CONDITIONS


1. Introduction

These Terms and Conditions govern all bookings made with Twombili Tours Company Ltd., a family-owned adventure travel company based in Mbeya, Tanzania. By booking a tour, you confirm that you have read, understood, and agreed to these Terms. The primary client (the individual making the booking) accepts these terms on behalf of all travelers named in the booking.

2. Privacy and Data Protection

Twombili Tours is committed to protecting your privacy and managing personal information responsibly. By using our services, you consent to the collection and use of your data in accordance with our Privacy Policy.

3. Booking, Deposits, and Payments

  • Deposit: A non-refundable deposit of 20% of the total tour cost is required to secure a booking.

  • Final Payment: The balance must be paid no later than six weeks before the tour starts. For bookings made within six weeks of departure, full payment is due upon confirmation.

  • Payment Instructions: Provided via email. All payments must be made free from bank fees or transaction surcharges.

4. Booking Agreement

A booking is confirmed when Twombili Tours receives the deposit and sends a written confirmation. The client must:

  • Be at least 18 years old.

  • Provide accurate personal information.

  • Obtain necessary consent for group bookings.

5. Medical Conditions

All clients are required to truthfully provide relevant medical information upon booking their tour. Clients are responsible for assessing their own suitability and capability to participate in a tour. It is strongly recommended that all clients consult their physician regarding their fitness for travel and any necessary vaccinations or medical precautions.

Twombili Tours operates adventure tours that may take clients to remote or less developed regions where medical facilities may not meet the standards of their home country. The quality of medical facilities in these areas varies, and Twombili Tours makes no representations or guarantees regarding the availability or quality of medical treatment.

6. Modifications and Itinerary Changes

6.1 Changes by the Client

After booking confirmation, clients may request modifications to their itinerary, arrival date, or to replace a traveler. We will make every effort to accommodate your requests, subject to availability and the following conditions:

  • Modifications within 10 days of booking confirmation:
    If you identify any errors (e.g., misspelled names) or wish to make changes within 10 days of booking confirmation, please notify us promptly to avoid additional charges. Modifications requested after the 10-day period will incur a modification fee of $100

  • Modifications 61+ days before departure:
    If your departure date is more than 61 days away and 20% of the itinerary cost has been paid, you can modify the itinerary, activities, accommodations, or route. A $60 administrative fee will apply per modification. The original services will be canceled, and the new services will be charged at updated rates.

    Arrival Date Modifications:
    If you wish to change your arrival date to a later one, you must request this 61+ days before departure. The new date must be within 12 months of the original travel date, and the change is limited to one modification. You will be charged an administrative fee of $100, and any additional costs for new services will be passed on to you.

  • Modifications up to 7 days before departure:
    You may request to replace a traveler no later than 7 days before departure. The replacement traveler must meet all the conditions specified in the agreement. Any associated costs (e.g., for flights, accommodations, excursions) will be passed on to you. A $100 administrative fee will apply per traveler replaced.

    No Modifications within 7 Days:
    Requests made less than 7 days before departure will be treated as cancellations, subject to the cancellation charges outlined in these Terms and Conditions.

6.2 Changes by Twombili Tours

While it is unlikely that we will need to make changes to your holiday, Twombili Tours reserves the right to modify itineraries due to unforeseen circumstances. In most cases, changes will be minor, and we will inform you in writing as early as possible.

  • Major Changes:
    In the event of a major change, such as significant alterations to accommodations, or activities (and provided these changes are not due to force majeure or airline schedule changes), Twombili Tours will make every reasonable effort to ensure that the quality and value of your experience remain comparable. If substantial changes occur, we will give you a reasonable time to:

    • Accept the change,

    • Choose an alternative holiday,

    • Claim a price reduction,

    • Terminate the package tour agreement and receive a full refund.

    In all cases, additional compensation beyond the options provided is not available.

  • Minor Changes:
    If changes are considered minor (i.e., they do not significantly affect your confirmed holiday based on the information provided during booking), we will inform you, but no compensation or alternatives will be provided.

  • Force Majeure:
    Twombili Tours is not liable for any changes or cancellations due to unforeseen or unusual circumstances beyond our control, including but not limited to natural disasters, political instability, or other force majeure events. In such cases, no compensation or options will be available.

  • Children under 2 Years Old:
    Children aged 2 and under are not eligible for compensation, even in the case of changes.

7. Cancellations & Refunds

Planning a safari requires extensive preparation, and cancellations can have a significant impact. To ensure fairness to all parties, the following cancellation policy applies:

Client Cancellations:

  • 61+ days before departure: Loss of deposit.

  • 60-45 days before departure: 40% of total cost.

  • 44-29 days before departure: 75% of total cost.

  • 28-7 days before departure: 90% of total cost.

  • Less than 7 days before departure: 100% of total cost.

Company Cancellations:

If Twombili Tours cancels a tour for reasons other than non-payment or force majeure, clients may choose:

  • An alternative tour of similar value (subject to price adjustments if necessary).

  • A full refund of all payments made.

8. Travel Insurance

Comprehensive travel insurance covering medical emergencies, evacuation, repatriation, cancellations, and personal loss is mandatory for all clients.

9. Prices, Surcharges, and Taxes

Price Adjustments

Prices are subject to change due to external factors such as:

  • Accommodation costs.

  • Fuel prices.

  • Taxes and government fees.
    Clients will be notified of any significant increases. If surcharges exceed 10% of the total tour cost, clients may cancel without penalties within 14 days of notification.

9.1 Website Pricing

All prices published on www.twombilitours.com are per person (unless otherwise stated) and quoted in US Dollars. Costs for obtaining passports or visas, tips for guides, drivers, and hotel staff, insurances, additional excursions, or personal expenses are not included in the itinerary cost.

All prices on the website should be used as a guideline only. Twombili Tours cannot be held responsible for any changes or pricing errors. The company will provide actual costs in its quotation proposals, which are valid for 3 weeks. Interim proposal changes are subject to overall travel package price changes.

10. Itinerary Changes

Twombili Tours reserves the right to adjust itineraries due to unforeseen circumstances, including but not limited to:

  • Weather conditions.

  • Political unrest.

  • Mechanical issues.
    No refunds will be provided for unused services caused by such changes.

11. Assumption of Risk

Adventure travel involves inherent risks, including potential lower safety standards compared to clients’ home countries. By booking, clients acknowledge and accept these risks.

12. Special Requirements

While Twombili Tours will make efforts to accommodate special requests (e.g., dietary preferences), these cannot be guaranteed.

13. Complaints & Disputes

All complaints should be reported immediately during the trip via:

Post-trip complaints must be submitted in writing within 30 days of the tour’s conclusion.

14. Liability Limitations

Twombili Tours is not liable for losses or damages arising from:

  • Client negligence.

  • Acts or omissions of third parties.

  • Force majeure events (e.g., war, natural disasters, pandemics).

  • Theft, loss, or damage of personal belongings.

15. Intellectual Property

All content, logos, and trademarks on Twombili Tours’ website are owned by the company and protected by intellectual property laws.

16. Images & Marketing

Twombili Tours reserves the right to use any photographs and videos taken during tours for marketing or other advertising purposes. By booking a tour, clients give consent to the use of such images and authorize Twombili Tours to retain copyright ownership of these materials.

17. Travel Documents

Clients are responsible for ensuring they have valid passports, visas, and vaccinations as required by destination countries. Twombili Tours is not liable for any issues resulting from incomplete or invalid travel documentation.

18. Governing Law

These terms are governed by Tanzanian law. Any disputes arising from bookings or services provided will be subject to the exclusive jurisdiction of Tanzanian courts.

19. Amendments

Twombili Tours reserves the right to amend these Terms & Conditions at any time. Clients with existing bookings will be notified of changes, and the updated terms will automatically apply unless a written objection is submitted within two weeks of notification.
